For employees to get the right amount of compensation when they get injured, every employer needs to know about the Return-to-Work Supplement Program.
Senate Bill 863 has in it a component that is called the Return-to-Work Supplement Program. Labor Code section 139.48 requires the Director to administer $120 million towards a fund for the purpose of making supplemental payments to workers who suffer from a permanent disability and get benefits that are disproportionately low in comparison to their earnings losses.
This program is based on studies conducted by RAND regarding the permanent disability of an employee; specifically in “identifying permanently disabled workers with disproportionate earnings losses for supplemental payments.”
Eligibility for the Return-to-Work Supplement Program
The applicant (the employee, in this case) must have had an injury on or after January 1, 2013, and have received a Supplemental Job Displacement Benefit voucher for that injury.
The Deadline for Applying
The application for the Return-to-Work supplement must be handed into the office of the Return-to-Work Supplement Program within one year from the date the supplemental Job Displacement Benefit voucher was served on the applicant, or one year from the date from which the program was amended.
How to Apply
- The entire SJDB voucher including proof of service (the voucher must be in .pdf or .tiff format in order to submit the form online).
- Adjudication (ADJ) Number (you can use public information searches to find your case and your ADJ number. If you cannot find your ADJ number, please contact the I&A office that is nearest to your place).
- Workers’ Compensation claim number (claim numbers are assigned by the claims administrator computer system upon filing an injury claim form).
